Rapper Gucci Mane continues to prove he's just as notorious for his bombastic music as he is for enthusiastically ramming his head into the brick wall of the law. The southern hip hop star was indicted on one count of aggravated assault Tuesday after allegedly breaking a champagne bottle over a solider's head in an Atlanta night club.

Gucci Mane, real named Radric Davis, is accused of slamming the bottle over the unidentified solider's head at the club Harlem Nights in Atlanta in late March. Davis was at the club to promote his new mixtape, according to a promotional flier for the event.

The solider - who only wanted to be identified by his first name, James - told local news that he saw Gucci hanging out in the VIP section of the club. James said he approached one of Davis' security guards, asking the man if he could get a picture with Gucci Mane.

"I'm in the military. I wanted to get a picture with Gucci Mane," James explained to WSB-TV. "I was speaking to the security guard, and Gucci Mane hit me in the head with a bottle."

A solider in the Army, James said he was in Atlanta for the first time to celebrate his birthday with some friends. He said he was in disbelief when Davis reacted so violently to his innocent question.

"And as I looked at him in the shock of why, one of his friends hit me in the side of my face," James said.

"That is dangerous because if there was to be any other fan trying to approach him, ain't no telling what else he might do to them," he added.

James is now recovering from a concussion and said he suffers from intense headaches.

"He could have possibly killed me. I just hope and pray that I recover pretty well because I still want to serve my military career," James said.

This is far from the first time Davis has gotten mixed up with the wrong end of the law. The rapper has been thrown in jail five times over the last eight years for drug, weapon and assault charges. Davis served six months in jail for pleading guilty in September 2011 to shoving a woman out of his car while it was moving.
