A Californian is suing Apple Inc. CEO Tim Cook over the Cupertino-based organization's latest mobile operating system.

Mark David Menacher has filed a case against Tim Cook in San Diego's Superior Court of California claiming iOS 7 automatically installed on his Apple device.

The problem?

Menacher didn't want iOS 7.

The Californian wants Apple to remove iOS 7 from his family's devices.

"Apple's disregard for customer preferences in relation to iOS 7 is corporate thuggery," said Menacher, in a statement, via CNET. "Steve Jobs was reportedly rough on company employees in pursuit of happy customers, but Tim Cook apparently cultivates a culture of contempt for customer satisfaction in pursuit of corporate profits. It is a policy that will eventually fail."

iOS updates can be downloaded automatically when connecting to power and a Wi-Fi connection. iOS 7 cannot be downgraded back to iOS 6 even if connecting to iTunes.

Apple has not commented on Menacher's claim.

iOS 7 started to rollout on Sept. 18. As Latinos Post reported, Apple has since issued the iOS 7.0.2 update on Sept. 26. According to the Cupertino-based organization, the update features bug fixes that previously allowed someone to bypass the lock screen's passcode and reintroduces a Greek keyboard option for the passcode's entry. Latinos Post reported about a glitch allowing users to bypass the lock screen via the Control Center of iOS 7. The bypass could allow the user to access one's email, photos, social media and more.

iOS 7 is available for the iPhone 4S, iPhone 5, iPhone 5C, iPhone 5S, iPad 2, iPad 3, iPad 4, iPad mini, and the fifth generation of the iPod touch.
