The $1.05 billion Apple victory in the patent infringement trial has been cut, almost by half.

Apple and Samsung have been locked in a patent infringement trial worldwide, but a case in San Jose, Calif. saw the Cupertino-based company win over Samsung last August.

However, the judge presiding over the case, U.S. District Court Judge Lucy H. Koh, issued a ruling on Friday which cut the billion-dollar victory down 40 percent.

The 40 percent equates to approximately $450.5 million.

The original $1.05 billion verdict was determined by a jury, and Judge Koh did comment on ruling over the jury's decision.

"It is not the proper role of the court to second-guess the jury's factual determination as to the proper amount of compensation," said Koh.

Judge Koh noted the jury had incorrectly calculated portions of the alleged infringed patents and issued a new trial was needed to determine their cost.

"The need for a new trial could have been avoided had Apple chosen a more circumspect strategy or provided more evidence to allow the jury or the court to determine the appropriate award for a shorter notice period," she said in her ruling.

A trial has been set for March 2014, which will feature devices such as Samsung's Galaxy S3 and Apple's iPhone.

"We are pleased that the court decided to strike $450,514,650 from the jury's award," said Samsung said in a statement. "Samsung intends to seek further review as to the remaining award."

Apple has not commented on the ruling yet.
