In the latest ruling in the Apple vs. Samsung patent infringement trial in San Jose, California, it might be a mixed victory for Samsung and Apple.
Apple has previously made a bid to ban 26 Samsung devices following the $1.05 billion verdict on Aug. 21 earlier this year.
US District Judge Lucy H. Koh ruled on Dec. 17 against banning the Samsung devices.
Judge Koh stated, "First and most importantly, Apple has not been able to link the harms it has suffered to Samsung's infringement of any of Apple's six utility and design patents that the jury found infringed by Samsung products in this case. The fact that Apple may have lost customers and downstream sales to Samsung is not enough to justify an injunction."
According to Samsung, only three of the 26 products that Apple sought to ban are still being sold: the Galaxy S II by T- Mobile, Galaxy S II Epic, and Galaxy S II Skyrocket.
Samsung and Apple did file back in November to add the iPhone 5 and Galaxy S3 to the patent infringement case, which will be scheduled for trial in 2014.
Furthermore, Judge Koh denied Samsung's bid for a retrial following allegations the jury foreman of the summer trial was prejudiced against Samsung due to Seagate, a company Samsung have invested in, suing him.
To add onto the US ruling, Samsung announced it will withdraw its patent lawsuits against Apple in Europe. Patent infringement trials have been taking place in France, Germany, Italy, Netherlands, and the United Kingdom.
"Samsung has decided to withdraw our injunction requests against Apple on the basis of our standard essential patents pending in European courts, in the interest of protecting consumer choice," stated the South Korea-based company.
